OSHA Announces Penalty Adjustment for 2019 Citations

Since the 2016 Federal budget was passed, OSHA has increased their maximum citation penalty amount to adjust for inflation on a yearly basis. The 2019 increase has recently been announced.

Upon publication of the Federal Register, the new maximum OSHA citation penalties will be:

  • Serious, Other-Than-Serious, and Posting Requirements: $13,260 (up from $12,934)

  • Failure to Abate: $13,260 (up from $12,934) per day after due date

  • Willful or repeat: $132,598 (up from $129,336)

The increase amounts to a 2.5% increase over the previous year. The Federal Register is only currently in pre-publication mode and was released on January 15, 2019.  It’s not yet clear when it will be officially published.
